Berman also led his firm to win a suit against Apple and various publishing companies in 2016 that settled for a total of $560 million on behalf of e-book purchasers forced to pay artificially high prices due to Apple and the publishing companies’ colluded price-fixing. That suit went to the Supreme Court, where the Court ruled against Apple. The firm also recently filed a $1 billion case against Apple regarding antitrust policies within Apple Pay. Additionally, Hagens Berman took Google to court on behalf of Android app developers using the Google Play Store, achieving a $90 million settlement on behalf of the class. Apple Antitrust Déjà Vu: This filed lawsuit against Apple accuses it of the same antitrust overpricing in its App Store functionality and in-app purchase (IAP) services and seeks to represent France-based iOS developers that were subjected to Apple’s high commissions, fees and other policies. The class action’s named plaintiffs include Société du Figaro (developer of the Figaro news app and IAP subscriptions), L’Équipe 24/24 (developer of L’Équipe sports news and streaming app, and IAP subscriptions) and le GESTE, a French association comprised of France-based publishers of online content and services, including iOS developers. Plaintiffs claim they purchased overpriced iOS app-distribution and IAP services. The case was filed in the U.S. District Court for the Northern District of California, bringing the France-based developers’ claims to Apple’s homecourt. It accuses Apple of engaging in anticompetitive practices in mandating only one app store for iOS devices, which set the stage for Apple to abuse its market power. For almost 14 years, Apple has levied a default 30% commission on paid app and digital in-app product sales conducted through the App Store and in iOS apps acquired from the App Store, according to the lawsuit. Apple also requires developers to pay it an annual fee if they want their apps and in-app products to be considered by Apple for distribution in the App Store. This is especially damaging to smaller and new developers. Putting all iOS apps into one marketplace also means consumers never see most apps, attorneys say, stifling competition and innovation. According to a legal filing made by Apple last year, there were at that time more than 2 million apps available on the App Store. The lawsuit representing France-based iOS developers seeks to force Apple to end its abusive monopoly and allow competition in the distribution of iOS apps and related products, to get rid of pricing mandates, and to reimburse developers for overcharges made through abuse of its monopoly power. The Preceding Developer Settlement: In 2021, the firm secured its $100 million settlement on behalf of U.S. iOS developers, which resulted in the creation of a Small Developer Assistance Fund and important changes to App Store policies and practices. In that settlement, small U.S. iOS developers – those with less than $1 million in App Store proceeds through all associated developer accounts per calendar year from June 4, 2015 to Apr. 26, 2021 – can receive payments ranging from minimums of $250 to $30,000 or more, based on historic participation in the iOS App Store ecosystem. In addition to monetary relief, the settlement brought changes to App Store policies and practices for U.S. iOS developers as they relate to App Store search results, app and in-app product price points, appeals from rejections of apps and transparency. Small U.S. iOS developers also will benefit from a pledge that for at least three years following court approval of the settlement, Apple will not raise the 15% commission rate that applies for those participating in its Small Business Program. Among other benefits of the settlement, Apple will permit all U.S. iOS developers to communicate with their customers outside their apps about purchasing methods other than Apple’s IAP system. Apple also will remove the prohibition against U.S. developers using information obtained within their apps to communicate with their customers outside their apps about the use of purchasing methods other than IAP, subject to consumer consent and opt-out safeguards.

He will have to wear a hearing aid for the rest of his life, according to the lawsuit.The parents are suing Apple, Luxshare-ICT, Inc. and Luxshare Precision Industry Co. LTD for negligence and fraud for failing to properly design and test the devices, failing to warn users that the earbuds are prone to rapid and unexpected increases in ear volume, and failing to properly manufacture the AirPods. Parus Files Second Patent Lawsuit Against Apple for Infringement of its Proprietary Voice-Browsing and Device Control Technology

Parus Holdings Inc. announced that it has filed a second patent infringement lawsuit in the U.S. Federal District Court for the Western District of Texas against Apple Inc. The lawsuit alleges that Apple infringes on Parus' patents for voice-browsing and device control technology. The lawsuit is based on U.S. Patent No. 6,721,705 and U.S. Patent No. 8,185,402. Parus is seeking all available remedies, including damages against Apple for all of its infringing sales. The lawsuit asserts that the infringement has been "willful," and requests that Apple be ordered to pay treble damages and Parus' attorneys' fees, and be permanently enjoined from infringing the Parus Patents. This is the second lawsuit Parus has filed against Apple relating to its use of Parus' voice-user interface technologies for retrieving information. The '431 and '084 Patents are asserted in the district court cases against Apple, Google, and Samsung (6-19-cv-00432, 6-19-vc-00433, 6-19-vc-00438) in the Western District of Texas and the case against LG (3-20-cv-05896) in the Northern District of California, all filed in 2019. These district court cases have been stayed pending the results of various IPRs. Parus also has asserted different patents in other district court cases currently pending in the Western District of Texas against Microsoft and Google. Earlier this month, Parus secured an important victory against Apple at The Patent Trial and Appeal Board (PTAB) of the U.S. Patent and Trademark Office, as it rejected in its entirety Apple's attempt to invalidate key Parus patents.

Amazon in May agreed to pay about $1 billion per year to become the exclusive provider of Thursday Night Football games beginning next year. That deal made Amazon Prime Video the first-ever streaming service to own an exclusive NFL broadcast package. An Amazon spokesman declined to comment on “Sunday Ticket” discussions. The NFL is expected to ask for $2 billion to $2.5 billion per year for the package and wants to wrap up discussions before the season ends in February, two of the people said. “Sunday Ticket” has been owned by DIRECTV, LLC (DirecTV) for the past 27 years. Talks are progressing with interested parties, suggesting the league is getting closer to choosing a new provider, said the people. DirecTV, which AT&T spun out as a new company last month, renewed “Sunday Ticket” in 2014 for eight years. The current contract ends after the 2022-23 season. Amazon has competition for the Sunday game rights. ESPN Chairman Jimmy Pitaro told Bloomberg this week that “Sunday Ticket” is “an incredibly valuable product” and acknowledged that Disney has had exploratory conversations with the league. NBCUniversal’s Peacock is not expected to bid for the rights, according to a person familiar with the matter. Notably, the WDTX Court rejected the defendants’ argument that the 2021 Mobile Gateway cases in WDTX were similar the earlier cases VoIP-Pal had litigated in the NDCA. The NDCA court denied VoIP-Pal’s motions to dismiss the Apple and AT&T cases based on VoIP-Pal’s covenant not to sue on the ’606 Patent and ’872 Patent because the covenant was considered insufficiently broad to divest the NDCA Court of subject-matter jurisdiction. However, the NDCA Court dismissed Twitter’s action. U.S. Supreme Court: On September 3, 2021, the Company filed its reply brief in support of its petition for a writ of certiorari filed with the Supreme Court of the United States on June 25, 2021, in its ongoing appeal of an NDCA order invalidating U.S. Patent Nos. 9,537,762 (“the ’762 patent”), 9,813,330 (“the ’330 patent”), 9,826,002 (the ’002 patent) and 9,948,549 (“’549 patent”). In particular, VoIP-Pal has asked the Supreme Court to hold its case pending resolution of another case pending before the Court, American Axle & Manufacturing, Inc. v. Once a participating state begins offering this capability to its residents, customers will be able to add their driver’s license or state ID to Wallet and simply tap their iPhone or Apple Watch to present it to the TSA, without taking out their physical card or handing over their device. Adding a driver’s license or state ID to Wallet: Similar to how customers add new credit cards and transit passes to Wallet today, they can simply tap the + button at the top of the screen in Wallet on their iPhone to begin adding their license or ID. Presenting a driver’s license or state ID to TSA: Once added to Wallet, customers can present their driver’s license or state ID to the TSA by simply tapping their iPhone or Apple Watch at the identity reader. Upon tapping their iPhone or Apple Watch, customers will see a prompt on their device displaying the specific information being requested by the TSA. Only after authorizing with Face ID® or Touch ID® is the requested identity information released from their device, which ensures that just the required information is shared and only the person who added the driver’s license or state ID to the device can present it. Users do not need to unlock, show, or hand over their device to present their ID. Wallet provides a convenient and more secure way to present driver’s licenses and state IDs, while offering superior security and privacy over a physical wallet. Apple and the issuing states do not know when or where users present their IDs. Driver’s licenses and state IDs in Wallet take full advantage of the privacy and security built into iPhone and Apple Watch. Customers’ identity data is encrypted and protected against tampering and theft. Biometric authentication using Face ID and Touch ID ensures that only the person who added the ID to the device can view or present their ID or license in Wallet. Driver’s licenses and state IDs in Wallet are only presented digitally through encrypted communication directly between the device and the identity reader, so users do not need to unlock, show, or hand over their device. Attorneys at the law firm Hagens Berman announced details of a class-action settlement reached with Apple Inc. on behalf of small U.S. iOS app developers. The settlement will result in the creation of a $100 million Small Developer Assistance Fund and important changes to App Store policies and practices. The developers’ lawsuit was brought against Apple in 2019 in the U.S. District Court for the Northern District of California by Hagens Berman, Sperling & Slater, Saveri & Saveri, and Freed Kanner law firms. According to the lawsuit, Apple monopolized U.S. distribution services for iOS apps and in-app digital products, which resulted in commission overcharges to U.S. iOS developers. The Small Developer Assistance Fund created as part of the settlement will benefit over 99% of U.S. iOS developers, whose proceeds from app and in-app digital product sales through all associated accounts were less than $1 million per calendar year during the period from June 4, 2015 to Apr. 26, 2021. These developers can claim sums from the fund ranging between minimums of $250 to $30,000, based on their historic participation in the App Store ecosystem. Further, small and other U.S. iOS developers will benefit from changes to App Store policies and practices as they relate to App Store search results, app and in-app product price points, appeals from rejections of apps and transparency. Small U.S. iOS developers also will benefit from a pledge that for at least three years following court approval of the settlement, Apple will not raise the 15% commission rate that applies for those participating in its Small Business Program. Additionally, all U.S. iOS developers will benefit from a major change to the App Store Review Guidelines, which will remain in place for at least the same three-year period. As part of the settlement, Apple will permit all U.S. iOS developers to communicate with their customers outside their apps about purchasing methods other than Apple’s in-app purchase (IAP) system. Apple also will remove the prohibition against U.S. developers using information obtained within their apps to communicate with their customers outside their apps about the use of purchasing methods other than IAP, subject to consumer consent and opt-out safeguards. The terms of the agreement will help make the App Store an even better business opportunity for developers, while maintaining the safe and trusted marketplace users love. Apple appreciates the developer feedback and ideas that helped inform the agreement, and respects the ongoing judicial review process. The agreement clarifies that developers can share purchase options with users outside of their iOS app; expands the price points developers can offer for subscriptions, in-app purchases, and paid apps; and establishes a new fund to assist qualifying US developers. The updates constitute the latest chapter of Apple’s longstanding efforts to evolve the App Store into an even better marketplace for users and developers alike. Providing More Flexibility and Resources for Small Developers: Following a productive dialogue, Apple and the plaintiffs in the Cameron et al v. Apple Inc. developer suit reached an agreement that identifies seven key priorities shared by Apple and small developers, which has been submitted to the judge presiding over the case for her approval. In a validation of the App Store Small Business Program’s success, Apple and the developers agreed to maintain the program in its current structure for at least the next three years. Businesses earning less than $1 million annually will continue to benefit from the reduced commission, while larger developers pay the App Store’s standard commission on app purchases and in-app payments. App Store Search has always been about making it easy for users to find the apps they’re looking for. At the request of developers, Apple has agreed that its Search results will continue to be based on objective characteristics like downloads, star ratings, text relevance, and user behavior signals. The agreement will keep the current App Store Search system in place for at least the next three years. To give developers even more flexibility to reach their customers, Apple is also clarifying that developers can use communications, such as email, to share information about payment methods outside of their iOS app. As always, developers will not pay Apple a commission on any purchases taking place outside of their app or the App Store. Apple will maintain the option for developers to appeal the rejection of an app based on perceived unfair treatment, a process that continues to prove successful. Apple has agreed to add content to the App Review website to help developers understand how the appeals process works. Over the last several years, Apple has provided a great deal of new information about the App Store on apple.com. Apple agreed to create an annual transparency report based on that data, which will share meaningful statistics about the app review process, including the number of apps rejected for different reasons, the number of customer and developer accounts deactivated, objective data regarding search queries and results, and the number of apps removed from the App Store. Apple will also establish a fund to assist small US developers, particularly as the world continues to suffer from the effects of COVID-19. The News Partner Program aims to ensure Apple News customers maintain access to trusted news and information from many of the world’s top publishers, while supporting publishers’ financial stability and advancing efforts to further media literacy and diversity in news coverage and newsrooms. The News Partner Program is designed for subscription news publications that provide their content to Apple News in Apple News Format (ANF). ANF enables an exceptional reading experience on Apple News and unlocks the full benefit of the platform for publishers, and empowers publishers to create brand-forward stories, immersive issues, and audio stories, with designs that scale seamlessly across Apple devices. ANF also supports advertising, and publishers keep 100% of the revenue from advertising they sell within Apple News. To support publishers who optimize more of their content in ANF, Apple News is offering a commission rate of 15% on qualifying in-app purchase subscriptions from day one. Publishers may apply for the News Partner Program beginning now. Eligibility and requirements: Participants must maintain a robust Apple News channel in Australia, Canada, the United States, and the United Kingdom, and publish all content to that channel in ANF.
